1. Provider and contractual documents
The service is provided by Trainingforever OÜ, an Estonian company entered in the Estonian business register under code 16941437, VAT number EE102717330, with its registered office at Narva mnt 5, Kesklinna linnaosa, Tallinn, Harju maakond, 10117, Estonia. Contact: [email protected] and +34 644 296 942. Main website: https://trainingforever.com.
These terms govern the account and use of TrainingForever. The accepted offer or order determines the features, price, duration and limits of the specific plan. The DPA is incorporated where TrainingForever processes data on behalf of a professional customer or organisation.
The Privacy Policy, Cookie Policy and Legal Notice provide the relevant information. Their provision does not replace consent that must be requested separately. For data protection, the DPA takes precedence in relation to processing on behalf of the customer; no specific terms may reduce mandatory rights.
2. Users and capacity
Athletes, coaches, authorised club personnel and other organisations may use TrainingForever. The subscription holder may be different from a person using the application by invitation.
Purchasing a plan requires being of legal age with sufficient legal capacity, or valid representation of the contracting entity. Anyone contracting on behalf of an entity declares that they have authority to bind it and accepts the DPA on its behalf where appropriate.
Minors may only be enrolled as athletes through an enabled procedure allowing verification of the authorisations and information required by their age and applicable law. If that procedure is unavailable, minors' data must not be entered and their accounts must not be enabled. The age for consenting to a digital service does not replace the rules on contractual capacity or health data processing.
Consumer status depends on the actual purpose of the contract. Identifying yourself as a coach or using a free plan does not, by itself, remove any rights provided by law.
3. What the platform offers
TrainingForever is a digital service supporting sports planning and management. Depending on the purchased offer, it may include:
The list describes types of features; it does not assure that all are available on every plan, device or connection. The offer and compatibility documentation must identify the included features and known restrictions before purchase. Features announced as forthcoming will not be considered available until they are actually introduced under the terms communicated.
Specific sports results and universal compatibility are not guaranteed. This does not reduce the obligation to provide the functions and features promised.
4. Account and authorised persons
You must provide accurate information and keep the contact details necessary for the service up to date. Credentials are personal and must be protected. Report any suspicious access to [email protected].
A club or coach must assign permissions according to the actual role, remove access that is no longer necessary and manage invitations lawfully. Being an administrator does not authorise use of any data for any purpose.
Each party is responsible for breaches attributable to it. Activity recorded in an account does not automatically make the user liable for unlawful access caused by a service deficiency or circumstances beyond the diligence required of them.
5. Health and the sports relationship
The ordinary platform does not provide diagnosis, medical treatment, clinical nutrition or emergency care. Sports metrics and suggestions do not replace a healthcare assessment where one is necessary.
The coach or professional providing the sports service must hold the required qualifications and authorisations, assess the plan's suitability and supervise the decisions for which they are responsible. The athlete must reasonably communicate relevant limitations to the professional assisting them and must not follow a recommendation when they identify an obvious risk to their health.
Health-based features may only be used with a legal basis under Articles 6 and 9 GDPR and the corresponding information. Accepting these terms is not sufficient. Where explicit consent is used, it must be obtained from someone who can validly give it and must be capable of withdrawal.
Acceptance of these terms does not constitute a waiver of claims for injuries, software errors, security failures or other harm attributable to TrainingForever or a professional.
6. Responsibilities of coaches, clubs and organisations
When managing other people's data, the customer must:
TrainingForever retains its own obligations concerning security, confidentiality, assistance and lawfulness. These customer obligations do not transfer liability for TrainingForever's own breaches to the customer.
7. Clubs, groups, challenges and communication
Social features must be used respectfully and without harassment, discrimination, impersonation or unauthorised disclosure of data. Creating a group or club does not give its members general access to health information or other participants' private conversations.
Each publication, ranking or challenge must respect its visibility scope. Health data, minors' profiles and precise routes will not be published by default. Images of other people and disclosures to sponsors require their own authorisation where appropriate.
Changing club, coach or role does not automatically transfer authorisation to access the previous history. Access rights and retention will be adjusted to the new relationship and the previous controller's lawful obligations.
8. AI assistant and automated analyses
The assistant uses artificial intelligence and may generate errors, omissions or inappropriate inferences. Its use requires considering the context and reviewing proposals before applying them, especially where they affect health, intensity, recovery or someone other than the person giving the instruction.
Depending on the enabled features, the assistant may consult data and carry out actions within the account's permissions. A sufficiently specific instruction may result in execution without another confirmation question; not all interactions are merely suggestions. Operations for which the application requires confirmation will not be validly executed by omitting that step.
Before confirming, review the recipient, calendar, content and scope of the changes. The availability of an undo feature depends on the operation and its technical limits. A connection error does not, by itself, establish that an action was not carried out; check the status before repeating it.
Use of AI with health data, including any health inferences it may make, is subject to the applicable separate information and consent. Acceptance of these terms does not authorise the use of athletes' personal data to train general models or for other purposes unrelated to the service.
The assistant must not be used to make decisions without effective human involvement about contracting, insurance, recruitment or other situations with legal or similarly significant effects. Nor may it be used to issue healthcare diagnoses or prescriptions. TrainingForever must assess the safety and lawfulness of its own features; user review does not replace that obligation.
9. Automations and recurring actions
If the plan includes automations, their configuration must identify the objective, affected people or groups, trigger, frequency, actions, limits and means of deactivation. An authorisation is limited to that scope and does not permit new processing purposes.
Substantial changes in scope or new recipients require the relevant information and authorisations. The user must be able to revoke the automation for future actions. Revocation does not automatically reverse actions already taken or messages already delivered.
A proactive feature is not presumed enabled merely because a chat assistant or MCP connector exists.
10. Integrations, API and MCP
Connections are optional and depend on technical and contractual permissions. Only information authorised for the stated purpose may be imported or exported. Synchronisation of workouts and activities is limited to each integration's capabilities.
Third-party terms may impose restrictions on storage, display, analytics, AI, sublicensing and disclosure to others. Limits and authorisations must not be circumvented, and user consent does not remove a contractual prohibition imposed by the source service. If an integration ceases to be authorised, it will be limited or withdrawn with the corresponding contractual consequences.
Connecting ChatGPT, Claude or another external client through MCP may allow that service to receive data and request actions. You must review its permissions and privacy arrangements. You must not connect athletes' data to an external account without sufficient authorisation and safeguards. An external connection does not necessarily inherit the integrated assistant's controls, use limits or confirmations.
Revoking a connection stops the affected new exchanges but does not automatically erase copies already received by an independent recipient. TrainingForever will fulfil its applicable obligations concerning revocation, erasure and notification to recipients. For Garmin Connect data, disconnection also triggers the erasure provided for in section 9.1 of the Privacy Policy, including where the connection operates through Stridee. General retention of sports history does not extend that rule.
Third-party failures do not exclude TrainingForever's obligations regarding the promised service, its selection and configuration of providers or statutory conformity guarantees.
11. Permitted use and prohibitions
The following are not permitted:
These prohibitions do not restrict statutory exceptions for interoperability, authorised legitimate research, accessibility, portability or the exercise of rights.
12. Contracting, plans, trials and modules
Before an order is confirmed, the provider, features, limits, duration, total price, currency, taxes, billing frequency, renewal, any minimum commitment and cancellation methods will be displayed. The user will be able to review and correct errors before contracting. Paid options will not be added through pre-ticked boxes.
The contract is completed through express acceptance of these terms and confirmation of the order. The payment button will unambiguously indicate the obligation to pay. TrainingForever will send confirmation in a format that can be retained, with the applicable terms and withdrawal information where appropriate.
Additional modules, including features marketed as “Gemas” when offered, must state what they include, their duration, price and renewal. Their name does not make them currency, a balance or an investment. They will not be purchased through inadvertent use of a feature without information about and acceptance of its cost.
A free trial must identify when it ends and whether it converts to a paid service. Conversion requires clear information and acceptance of the relevant charges. Different professional terms will be documented in the order; they may not reduce applicable consumer rights.
13. Prices, invoices and payments
Prices aimed at consumers are shown inclusive of applicable taxes. If a professional offer displays prices excluding taxes, it must clearly state this and display the corresponding total before confirmation. VAT treatment depends on the customer, service and applicable tax law; these terms do not apply a single rate.
Payments are processed through the identified providers. Only necessary data will be supplied. Health data will not be requested to make an ordinary payment. The payment provider's terms do not alter the customer's rights against the seller of the service.
Invoices and receipts will be provided by the agreed means, respecting statutory rights concerning their format. Reversing a direct debit or rejecting payment does not, by itself, amount to valid cancellation of the subscription; you can cancel through the channels in the following section.
14. Coach or club services and their payments
A TrainingForever subscription and the sports service of a coach or club are separate relationships unless the offer expressly identifies Trainingforever OÜ as the seller of that service as well.
Before sports services are contracted, the seller, price, duration, renewals, minimum commitment, cancellation and complaints arrangements must be identified. Using a TrainingForever payment collection tool does not, by itself, change the seller's identity. The party providing the sports service will be responsible for its decisions and obligations, without prejudice to TrainingForever's own liability for its involvement.
The coach or club must fulfil its tax, professional and consumer obligations. It cannot impose a general waiver of rights on its athletes using these terms. Payment disputes will be addressed to the identified seller, and TrainingForever will cooperate where it is involved in processing or holds relevant information.
15. Renewal, cancellation and price changes
Automatic renewal applies only if clearly disclosed before contracting, with frequency, amount or calculation criterion and cancellation method. Cancellation may be requested through subscription management where available or by writing to [email protected] from the associated email address. Confirmation will be provided without imposing disproportionate procedures.
Unless applicable early termination occurs, cancellation prevents the next renewal and permits use of the paid period until it expires. It does not remove rights of withdrawal, termination for breach, statutory refunds or erasure. Closing an account must not be used to maintain future charges that have been requested to be cancelled.
Minimum commitments are enforceable only if clearly disclosed, valid and proportionate. Undisclosed penalties and unfair cancellation charges will not apply.
A price change will be notified on a durable medium at least 30 days before it applies and before an affected renewal, with the opportunity to cancel. If the law or offer requires longer notice or express acceptance, those requirements will be respected. The price of an already paid period will not be changed retrospectively.
16. Consumers' right of withdrawal
If you contract at a distance as a consumer, you may withdraw from the initial subscription contract within 14 calendar days from the conclusion of the contract, without giving a reason, unless a statutory exception applicable to a specific product has been validly disclosed and fulfilled.
You may send an unequivocal statement to [email protected] or the registered office. You may use the form in the annex, but this is not mandatory. An electronic withdrawal function will also be provided in the contracting environment during the applicable period, with confirmation on a durable medium. It is sufficient to communicate the decision before the period ends.
We will reimburse the applicable amounts without undue delay and, in any event, within 14 calendar days following communication, using the same payment method unless otherwise validly agreed and without any refund fee.
If you expressly request the start of a paid service during the withdrawal period and have received the statutory information, only a proportionate amount for the service actually provided up to your communication may be charged where the law permits. If those requirements are not met, that early start will not be charged for.
Accessing a SaaS service, creating an account or using a feature does not, by itself, extinguish the right of withdrawal. The exception for fully performed services requires the statutory conditions and is not presumed merely because an ongoing subscription has started. Any separate sale of digital content requires its own information and specific acceptance for any valid loss of the right; these terms do not presume them.
If proper information about withdrawal is not provided, the statutory extension of the period will apply. Professionals do not have this right merely because they contract online, unless it is granted in the offer or required by another rule.
17. Service conformity and updates
TrainingForever must supply the service with the features, compatibility, security, continuity and updates required by the contract and law. It is not marketed simply “as is” to exclude statutory guarantees.
Consumers may request that the service be brought into conformity and, where appropriate, a price reduction, termination and reimbursement, as well as other statutory rights. For continuous supply, liability for lack of conformity applies during the supply period under the statutory terms. Mandatory periods, burdens of proof and remedies are not reduced by these terms.
The user must install necessary updates that are communicated to them and enable safe use of the service where this is their responsibility. Failure to install will have only the consequences provided by law and only if the required information and assistance were provided.
18. Availability, maintenance and modifications
TrainingForever will take the required measures to maintain the service and communicate scheduled maintenance where reasonably possible. Any specific availability or support commitment must appear in the offer or a service level agreement; absolute availability is not presumed.
Changes may be made for justified legal, security, compatibility, maintenance or functional development reasons. For consumers, modifications to the digital service beyond what is necessary to maintain conformity are subject to statutory requirements: a valid reason provided for in the contract, no additional costs and clear information.
If a modification adversely affects access or use to a degree that is more than minor, reasonable advance information will be provided on a durable medium and the right to terminate free of charge within the statutory period will be recognised, normally 30 days from receipt of the information or from the change, whichever is later. Statutory exceptions will apply, for example where the unchanged, conforming service may be retained at no cost.
Substantial changes to these terms will normally be communicated at least 30 days in advance. Where renewed acceptance is required, it will be requested; silence or mere continued use will not be used to impose it contrary to law. Urgent action for security or legal obligations will be communicated as soon as possible.
19. Content, intellectual property and necessary licence
TrainingForever or its licensors retain rights in the software, brand and their own materials. A limited right of access and use is granted during the contractual relationship, in accordance with the purchased plan and statutory exceptions.
Users retain whatever rights they hold in the plans, texts, files, images and other content they contribute. They authorise TrainingForever to host, technically reproduce, process and display that content only to the extent necessary to provide the service, follow valid instructions and fulfil legal obligations. This authorisation does not permit its sale, publication outside the selected visibility or use to train general models.
The authorisation ends when those operations are no longer needed, without prejudice to technical copies and restricted statutory retention. Ownership of personal data is not transferred, and data do not lose their safeguards by being included in content.
AI outputs may not be exclusive, and it is not guaranteed that every output attracts copyright. Their use must respect third-party rights and applicable terms, without granting TrainingForever powers over personal data that it does not have.
20. Moderation, suspension and termination
Content or access may be restricted for an established breach, security risk, unlawful use, non-payment or legal requirement. The measure must be proportionate, limited to what is necessary and, where appropriate, allow the issue to be remedied. Urgency may justify action before notice.
Reasons, scope, duration and review mechanisms will be communicated where legally possible. The user may request human review at [email protected]. Additional mechanisms and periods required by digital services law will be provided according to the nature of the service, without making access to authorities or courts conditional on an internal complaint.
If termination is attributable to TrainingForever and affects paid services not provided, the applicable amounts will be refunded. Suspension does not justify indefinite retention of data or prevent applicable rights of access, recovery or erasure.
21. Export, exit and erasure
You may request an export of information you are entitled to recover through the available means or at [email protected]. It will be supplied in a structured, commonly used and machine-readable format where appropriate. Credentials, other organisations' data and materials legitimately excluded from disclosure will not be supplied.
The right to personal data portability and recovery of content and assets under other rules are separate rights. The format, coverage and technical limits of the service must be described before contracting at Pending: descripcion de exportacion y formatos.
For professional customers requesting an ordinary exit, a 30-day recovery period after termination will be granted, unless they request immediate erasure or a more favourable period applies. The DPA specifies return and erasure. Non-renewal does not authorise use of the data for other purposes.
Where the service falls within the switching obligations in Chapter VI of the EU Data Act, its requirements will also apply. The customer may request switching provider, moving exportable data and digital assets to its own infrastructure or their erasure. Reasonable assistance will be provided, and continuity and security maintained during switching.
In that case, no notice period exceeding two months will be required; the transitional period will be a maximum of 30 calendar days after the notice period, with justified extensions and communication of technical unfeasibility as permitted by law. Recovery will remain available for at least 30 days after the transitional period, and the contract will terminate according to the outcome and notification of switching or the erasure request. The list of exportable data and exclusions justified by rights or trade secrets will be documented without obstructing switching. TrainingForever will not impose a specific charge for the switching process, without prejudice to ordinary fees actually accrued and other lawful termination terms disclosed in advance. Any more favourable right will be respected.
Erasure from active systems and the backup cycle are governed by the Privacy Policy or DPA, according to the processing. Cancelling a subscription, closing an account and an erasure request have different effects; these will be explained and processed without misleading the user.
22. Liability
Each party is liable for damage caused by breaches attributable to it, considering its involvement, required diligence, causation and applicable law. TrainingForever's errors are not attributed to the user merely because they use AI or connect a service.
In exclusively professional paid relationships, and only for ordinary financial losses that may lawfully be limited, TrainingForever's aggregate contractual liability is limited to fees paid or payable for the affected service during the 12 months preceding the event. This limitation does not apply to wilful misconduct, gross negligence, personal injury, breaches of confidentiality or data protection, or other liability that cannot validly be limited. No zero liability limit is agreed for free services.
The professional limitation above does not apply to consumers. Their guarantees, remedies, compensation and mandatory rights are not limited. Nor are data subjects' rights under Article 82 GDPR or authorities' powers limited.
If a professional customer causes harm to TrainingForever by entering unlawful data or content, only legally required redress based on established liability and actual involvement will apply. There is no automatic obligation to assume every claim or indemnify TrainingForever for its own breaches.
23. Communications and evidence of contracting
Contractual communications will be sent to the registered email address or through a means allowing them to be retained. You must be able to obtain a copy of the accepted terms, order and DPA. TrainingForever will retain the version and proportionate evidence of acceptance according to the applicable periods.
Necessary security or contractual notices are separate from advertising. Optional commercial communications require the corresponding choice and a simple means of unsubscribing.
24. Complaints and dispute resolution
You can complain at [email protected] or the registered office. Identify the account, facts and requested remedy without providing unnecessary health data. Receipt will be acknowledged and a response given within a maximum of 15 days or, where a justified inability exists, the reason and expected date will be explained within that period, respecting any stricter statutory deadlines.
Consumers may approach the competent consumer bodies and alternative dispute resolution entities, including the Estonian consumer protection authority, and seek help from the European Consumer Centre in their country for cross-border disputes. The relevant entity and any required participation in a specific procedure will be communicated according to law. Voluntary membership of a particular arbitration scheme is not presumed.
Data protection complaints may be brought before the competent authority without exhausting the contractual procedure. The former European ODR platform is no longer operational and is not offered as a complaints route.
25. Governing law and courts
The contract is governed by Estonian law and applicable European Union law. If you contract as a consumer in a country towards which TrainingForever directs its activities, this choice does not deprive you of the protection of the mandatory rules that would apply without it; in particular, those of your habitual residence where Article 6 of the Rome I Regulation applies.
Consumers may use the courts competent under the applicable protective and jurisdiction rules, including those of their domicile where appropriate. TrainingForever does not impose exclusive jurisdiction of foreign courts on consumers.
For exclusively professional relationships, and unless a mandatory rule or valid specific agreement provides otherwise, the parties agree to the competent courts of Tallinn, Estonia. This clause does not alter complaint routes for persons affected by data processing or authorities' competence.
If a provision is invalid, the corresponding rule will apply and the remainder of the contract will continue where it can lawfully subsist, without reconstructing an unfair term to a consumer's detriment.
